i. According to Article 4, Paragraph 1 of the Overseas Compatriot Identity Certification Act, males approaching conscription age or of conscription age who currently have or formerly had household registration in the Taiwan Area and have not yet fulfilled their military service obligations, and who meet one of the following conditions may apply for the Overseas Compatriot Identity Certificate for Military Service:
(i) Applicants residing in a country or region with a permanent residence system must meet all of the following requirements at the time of application (none may be omitted):
(a)Have obtained permanent residence in the place of overseas residence. (List of countries with permanent residence systems: https://www.ocac.gov.tw/OCAC/Eng/Pages/VDetail.aspx?nodeid=340&pid=903
).
(b)Have accumulated residence abroad for at least four (4) years.
(c)Have resided continuously in the place of overseas residence for six (6) months, or have resided there for at least eight (8) months per year in each of the most recent two (2) years.
(ii) For applicants residing in a country or region without a permanent residence system, or in a country or region with a permanent residence system where obtaining permanent residence is difficult, all of the following requirements must be met at the time of application (none may be omitted):
(a)Have obtained legal residence status in the place of overseas residence for four (4) consecutive years, and be eligible to extend the residence period. (b) Have accumulated residence abroad for at least four (4) years.
(c) Have resided continuously in the place of overseas residence for six (6) months, or have resided there for at least eight (8) months per year in each of the most recent two (2) years.
Note: The determination of countries or regions where obtaining permanent residence is difficult and the corresponding types of residence status shall be jointly reviewed and publicly announced each year by the Overseas Community Affairs Council (OCAC) and the Ministry of Foreign Affairs (MOFA).
(iii) Males who currently have or previously had household registration in the Taiwan Area, who departed from Taiwan, and have legally and continuously resided abroad for ten (10) years, and have legally worked and resided in the place of overseas residence for at least four (4) years, and are eligible to extend their residence, may also qualify.
ii. Males approaching conscription age or of conscription age who have not yet fulfilled their military service obligations may have their eligibility to apply for the Overseas Compatriot Identity Certificate for Military Service restricted, and must meet the requirements set forth in the Regulations Governing Application for Overseas Compatriot Identity Endorsement by Males Who Have Not Completed Compulsory Military Service of Conscription Age or Near Conscription Age, as follows:
(i) For males approaching conscription age who were born overseas or who departed from the R.O.C. (Taiwan) on or before December 31 of the year they turned 15 (with a record of departure from Taiwan, regardless of destination or duration of stay), the total number of days stayed in the R.O.C. (Taiwan) during each year of the approaching-conscription period must not exceed 183 days, until they meet the conditions specified in Article 4, Paragraph 1 of the Overseas Compatriot Identity Certification Act.
(ii) For males of conscription age who were born overseas or who departed from the R.O.C. (Taiwan) on or before December 31 of the year they turned 15 (with a record of departure from Taiwan, regardless of destination or duration of stay), the total number of days stayed in the R.O.C. (Taiwan) during each year of the approaching-conscription period must not exceed 183 days, and they must not have returned to the R.O.C. (Taiwan) after reaching conscription age and before meeting the conditions specified in Article 4, Paragraph 1 of the Overseas Compatriot Identity Certification Act.
