(5) How is it determined that a male of conscription age who was born abroad or departed from the R.O.C. (Taiwan) on or before December 31 of the year he turned 15 (with a record of departure from Taiwan, regardless of destination or length of stay) has not stayed in the R.O.C. (Taiwan) for more than 183 days per year during the approaching-conscription period, and has not returned to the R.O.C. (Taiwan) after reaching conscription age until meeting the conditions specified in Article 4, Paragraph 1 of the Overseas Compatriot Identity Certification Act?

(1)First, confirm whether the applicant, after reaching conscription age (from January 1 of the year he turns 19), meets the following three conditions:
(a)Has obtained permanent residence in the place of overseas residence, or has held legal residence there for four (4) consecutive years and is eligible to extend the residence;
(b)Has accumulated residence abroad for at least four (4) years; and
(c)Has resided continuously in the place of overseas residence for six (6) months, or has resided there for at least eight (8) months per year in each of the most recent two (2) years.

(2)If the above conditions are met, during the approaching-conscription period (from January 1 of the year following his 15th birthday to December 31 of the year he turns 18), the applicant must not have stayed in the R.O.C. (Taiwan) for more than 183 days per year, and from January 1 of the year he turns 19 (the year he reaches conscription age) until the date he meets all three conditions listed in (a), (b), and (c), he must not have any record of returning to the R.O.C. (Taiwan).

(3)Example: The applicant was born in Taiwan on July 1, 2003, and at the age of five made his first trip abroad with family to Japan for five days (meeting the condition of having departed Taiwan before December 31 of the year he turned 15). He has held a non-immigrant visa in Thailand, valid for at least one year per visa, continuously for four years (with no interruptions), and currently holds a valid Thai non-immigrant visa. As of July 1, 2026 (the year he turns 23), he meets the following three conditions:
(a)Has held continuous legal residence in Thailand for four years under a one-year renewable non-immigrant visa and is eligible to extend the stay;
(b)Has accumulated residence abroad for four years; and
(c)Has resided continuously in Thailand for six months.

During the approaching-conscription period (from January 1 of the year following his 15th birthday to December 31 of the year he turned 18, i.e., 2019–2021), the applicant must not have stayed in Taiwan for more than 183 days per year, and after reaching conscription age (from January 1, 2022) until July 1, 2026, when all three conditions (a), (b), and (c) are met, he must not have any record of entering Taiwan to qualify for application.
