(1)First, confirm whether the applicant, during the approaching-conscription period (from January 1 of the year following his 15th birthday to December 31 of the year he turns 18), meets the following three conditions:
(a)Has obtained permanent residence in the place of overseas residence, or has held legal residence there for four (4) consecutive years and is eligible to extend the residence;
(b)Has accumulated residence abroad for at least four (4) years; and
(c)Has resided continuously in the place of overseas residence for six (6) months, or has resided there for at least eight (8) months per year in each of the most recent two (2) years.
(2)If the above conditions are met, the applicant must not have stayed in the R.O.C. (Taiwan) for more than 183 days per year during the approaching-conscription period.
(3)Example: The applicant was born in the United States on July 1, 2007 (meeting the condition of being born abroad) and holds a U.S. passport. He turns 18 in 2025 (2025 – 2007 = 18). As of December 1 in the year he turns 18 (2025), he meets the following three conditions:
–Has obtained a U.S. passport;
–Has accumulated residence abroad for four (4) years; and
–Has resided continuously in the United States for six (6) months.
Therefore, to qualify for application, his residence in the R.O.C. (Taiwan) during the ages of 16 (2023), 17 (2024), and 18 (2025) must not exceed 183 days per year.
