1、Nationals without household registration who return to the R.O.C. (Taiwan) and establish household registration during the approaching-conscription or conscription-age period (from January 1 of the year they turn 16 to December 31 of the year they turn 36) fall under Article 3 of the Regulations Governing Application for Overseas Compatriot Identity Endorsement by Males Who Have Not Completed Compulsory Military Service of Conscription Age or Near Conscription Age.
According to Article 4 of the same regulations, in addition to meeting the requirements of Article 4, Paragraph 1 of the Overseas Compatriot Identity Certification Act, applicants must also meet one of the following conditions:
(1) On or before December 31 of the year they turned 15, they had already met the requirements under Article 4, Paragraph 1 of the Overseas Compatriot Identity Certification Act, and their overseas residence status has remained valid and uninterrupted up to the date of application.
(2) Males approaching conscription age who were born abroad or departed the R.O.C. (Taiwan) on or before December 31 of the year they turned 15 must have stayed in the R.O.C. (Taiwan) for no more than 183 days per year during the approaching-conscription period before meeting the requirements under Article 4, Paragraph 1 of the Act.
(3) Males of conscription age who were born abroad or departed the R.O.C. (Taiwan) on or before December 31 of the year they turned 15 must have stayed in the R.O.C. (Taiwan) for no more than 183 days per year during the approaching-conscription period, and must not have returned to the R.O.C. (Taiwan) after reaching conscription age and before meeting the requirements under Article 4, Paragraph 1 of the Act.
2、After establishing household registration, the applicant's case must be re-reviewed by the Overseas Community Affairs Council (OCAC).
If the applicant is uncertain about eligibility after establishing household registration, it is recommended that before registration, they provide their R.O.C. (Taiwan) passport, valid proof of residence in the overseas location, and the Certificate of Entry and Exit Dates issued by the National Immigration Agency requested for the application period from birth up to the application date (including records under the R.O.C. (Taiwan) passport and any foreign passports, if applicable), for consultation with the OCAC.
