1. The "Regulations Governing Applications for Overseas Compatriot Identity Endorsement by Males Who Have Not Completed Compulsory Military Service of Conscription Age or Near Conscription Age" (Link hereinafter referred to as "the Regulations") apply to "near-conscription-age and conscription-age males who have previously had household registration in Taiwan and have not yet fulfilled their military service obligations."
2. A male who has obtained an Overseas Compatriot Identity Endorsement and has never previously established household registration in Taiwan shall become subject to compulsory military service if he returns to Taiwan to establish household registration for the first time during the near-conscription-age period (from January 1 of the year in which he turns 16 to December 31 of the year in which he turns 18) or during the conscription-age period (from January 1 of the year in which he turns 19 to December 31 of the year in which he turns 36), and shall be governed by the aforementioned Regulations.
3. If a National Without Household Registration holding a valid Overseas Compatriot Identity Endorsement returns to Taiwan and establishes household registration for the first time during the period from January 1 of the year he turns 16 to December 31 of the year he turns 36, the OCAC must determine whether he meets one of the conditions set forth in Article 4, Paragraph 1 of the Regulations before issuing an Overseas Compatriot Identity Certificate for Military Service Purposes.
(1) The applicant had already met the requirements set forth in Article 4, Paragraph 1 of the Overseas Compatriot Identity Certification Act (Link)before December 31 of the year in which he turned 15, and the residency qualification for the overseas place of residence has remained valid and uninterrupted up to the time of application.
(2) For males approaching conscription age who were born abroad or who departed Taiwan before December 31 of the year in which they turned 15, the cumulative number of days spent in Taiwan during each year of the near-conscription-age period must not exceed 183 days before they meet the requirements set forth in Article 4, Paragraph 1 of the Overseas Compatriot Identity Certification Act.
(3) For conscription-age males who were born abroad or who departed Taiwan before December 31 of the year in which they turned 15, the cumulative number of days spent in Taiwan during each year of the near-conscription-age period must not exceed 183 days, and after reaching conscription age, they must have no record of returning to Taiwan before meeting the requirements set forth in Article 4, Paragraph 1 of the Overseas Compatriot Identity Certification Act.
2. Before establishing household registration for the first time, the applicant may prepare the required documents (please refer to the application instructions for the required documents, Link) and visit the OCAC in person for consultation to confirm whether they would still qualify for overseas compatriot status after establishing household registration.
