Q10. An Overseas Compatriot Conscription Male becomes subject to conscription by law after residing in the R.O.C. (Taiwan) for 183 days. How is the 183-day period calculated?

1、For males with household registration in the R.O.C. (Taiwan) who hold overseas compatriot status:
(1)Have resided continuously for 183 days starting from the day following their return to the R.O.C. (Taiwan).
(2)Have resided for a total of 183 days within any given year (from January 1 to December 31) starting from the day following their return to the R.O.C. (Taiwan).

2、For males without household registration who hold overseas compatriot status and have newly established household registration after returning to the R.O.C. (Taiwan):
(1)Have resided continuously for 183 days starting from the day following the date of household registration.
(2)Have resided for a total of 183 days within any given year (from January 1 to December 31) starting from the day following the date of household registration.

3、Periods of residence shall include entries made with both R.O.C. (Taiwan) and foreign passports.

4、The following periods shall not be counted toward the total duration of residence:
(1)Periods during which an Overseas Compatriot Conscription Male returns to the R.O.C. (Taiwan) for study and qualifies for conscription deferment.
(2)Periods of residence in the R.O.C. (Taiwan) that are beyond the applicant's control, caused by disasters defined in Subparagraph 1, Article 2 of the Disaster Prevention and Protection Act or infectious diseases defined in Paragraph 1, Article 3 of the Communicable Disease Control Act, as approved by the Ministry of the Interior upon review by the competent municipal or county (city) government of the household registration.
