(1) A "male approaching military service age" means a male currently in the period from January 1 of the year after age 15 to December 31 of the year of age 18.
Pursuant to Regulations for Review Procedures Regarding Departures by Male Nationals Approaching Military Service Age, a person whose passport is stamped with "military service not performed", or a person approaching military service age who departs from the ROC (Taiwan) before December 31 of the year of age 15 and whose passport is not stamped with "military service not performed", and who enters or exits the ROC (Taiwan) prior to qualifying for an Overseas Compatriot Identity Endorsement, then unless there are special reasons approved by the Ministry of Interior, such a person may not receive an Overseas Compatriot Identity Certificate for Military Purpose.
However, a person who exits the ROC (Taiwan) before December 31 of the year of age 15, and who returns to the ROC (Taiwan) during the period of approaching military service age for periods not exceeding a cumulative 183 days in each year, may, upon qualifying for an Overseas Compatriot Identity Endorsement, directly apply to the Bureau of Consular Affairs or Foreign Representative Office for cancellation of the "military service not performed" stamp and apply for an Overseas Compatriot Identity Certificate for Military Purpose.
(2) A "male of military service age" means a male currently in the period from January 1 of the year after age 18 to December 31 of the year of age 36.
Pursuant to Departure by Male Nationals with Military Service Obligations Regulations, a male of military service age without overseas Compatriot identity who applies to exit the ROC (Taiwan) shall be subject to a passport with validity of three (3) years, which shall be stamped with "military service not performed".
Such a person may not apply for an Overseas Compatriot Identity Certificate for Military Purpose except with approval from the Ministry of Interior.
